GDPR: Risks of processing personal data on an inappropriate legal basis – Example Tracking & Profiling

DSGVO: EU-DS Committee severely restricts possibilities to “use” legal bases for online services

You will find my article in the current CIS Newsletter. The article is not quite short, but it is particularly worth reading if you cannot rule out the possibility that your data protection declaration, for example, is based on the wrong legal basis for your data processing operations. Then you would have the risk that a simple change of the legal ground “against good faith” (Art 5 para 1 lit a GDPR), the data processing would be inadmissible and the data to be deleted.

We offer various DSGVO conformity tests. From narrowly defined topics (e.g. short legal ground examination) to GDPR full compliance examination. The content and scope of the checks are adapted to your individual data protection risks and DS objectives. You will receive a list of practical suggestions for improving your compliance. We also like to work in an interdisciplinary team. The lawyer and his agents are subject to a strict obligation of secrecy, also vis-à-vis authorities.
